Privacy Statement for the IAPH Website

The International Association of Ports and Harbors (IAPH) is a non-profit-making organization with its head office in Tokyo, Japan and manages the IAPH website (https://www.iaphworldports.org/). IAPH understands the importance of protecting and safeguarding privacy when visiting the IAPH website. This Privacy Statement informs you about the information the IAPH website may collect, how the information is used, and how you can access and correct certain information that we may collect.

If you as a visitor choose to register or submit information via the IAPH website, you will become a “Registered User” and you agree to the use of such data in accordance with this Privacy Statement and the Terms of Use that you have accepted during your registration (“Terms of Use”). Also note that IAPH may use third parties to host all or portions of, or to assist in maintaining, the IAPH website.

You can access the public area of the IAPH website without submitting any personally identifiable data. Personnel of IAPH member organizations and individual IAPH members may voluntarily choose to provide IAPH with identifiable personal data by completing a registration form for access to the members-only area of the IAPH website or by filling out the contact form on the IAPH website. The personally identifiable data that we would collect from you if you so choose would typically include your name and title, email address, mailing address, telephone, social media details and information about your organization. These data are reasonably necessary for mutual communication among IAPH member organizations and individuals and fulfilling your requests and providing you with the most relevant, targeted offers and information from IAPH. All such data collected shall be referred to herein as “Personal Data”.

Furthermore, IAPH may monitor incoming and outgoing IAPH website traffic data to help diagnose problems with its servers and to manage the IAPH website and services and content provided via the website. IAPH may use this data to assemble broad demographic information about its visitors, customers, and partners in general.

By submitting your Personal Data, you consent to the collection and use of your Personal Data as described in this Privacy Statement and – if you registered – the Terms of Use. IAPH may share Personal Data that you submit in order to gain access to the members-only area of the IAPH website with IAPH management and secretariat. Such parties are prohibited from using that information for any other purpose.

IAPH member organizations and individuals may be located all over the world and Personal Data collected on the IAPH website may hence be stored and processed in any country in which IAPH maintain facilities. This may include transfer to countries without data protection rules similar to those applicable in your country of residence. You acknowledge and agree that by providing Personal Data to IAPH through this IAPH website, you consent to the transmission of such Personal Data over international borders as necessary for mutual communication among IAPH member organizations and individuals.

Due to the existing legal, regulatory, and security environment, IAPH may be required, under certain circumstances, to disclose aggregate level and/or personally identifiable data submitted to IAPH through the IAPH website. IAPH will use reasonable efforts to limit such disclosures to the following circumstances: (i) where IAPH believes in good faith that it is required to do so in response to a subpoena or other legal process; (ii) where reasonably required to do so in order to maintain, update or otherwise implement IAPH’s data security measures, equipment, technical operations and the like; (iii) where reasonably necessary to identify, contact, or bring legal action against persons or entities to preserve and/or enforce IAPH’s rights, including but not limited to enforcing the Terms of Use for the IAPH website; (iv) to protect and to defend the rights or property of IAPH; or (v) in urgent circumstances to protect the personal safety of the public or of users of the IAPH products, services, and the IAPH website. In addition, IAPH may also disclose Personal Data in connection as part of a security audit.

IAPH undertakes substantial efforts to protect the confidentiality of the Personal Data, preferences and other information it has collected through the IAPH website and will never knowingly allow access to this information to anyone outside IAPH other than as described herein.

You should also do your part in protecting your information. Your UserID and any password (if such is provided or enacted) are confidential, and you are responsible for retaining such confidentiality. Unfortunately, due to the nature of the internet as a public transmission network, neither IAPH’s network nor data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect Personal Data that is transmitted to us by you, IAPH cannot ensure or warrant the security of such information.
